§1 DEFINITIONS
Business days – the days from Monday to Friday, excluding public holidays.
Account – a free-of-charge feature of the Store (an electronic service) governed by separate terms and conditions, which allows the Buyer to create their individual Account in the Store.
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Buyer – any entity making a purchase in the Store.
Terms and Conditions – these terms and conditions.

§3 TECHNICAL REQUIREMENTS
For the proper functioning of the Store, the following is required:

To place an order in the Store, in addition to the requirements specified in section 1, an active email account is required.
§4 SHOPPING IN THE STORE
The prices of goods displayed in the Store are total prices for the goods and include VAT.
The Seller points out that the total price of the order consists of the amounts indicated in the Store: the price of the goods and, where applicable in a given case, the costs of delivering the goods.
The selected item to purchase must be added to the cart in the Store.
Next, the Buyer selects from the options available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to process the placed order.
The order is placed at the moment the Buyer confirms its contents and accepts the Terms and Conditions.
Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
The Seller shall provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium no later than at the time the goods are delivered.
The Buyer may register in the Store, i.e. create an Account, or make purchases without registration by providing their details with each potential order.
§5 PAYMENTS

We accept payments by VISA, MasterCard and Maestro cards.
Some banks offer Visa and MasterCard cardholders additional security measures in the form of a PIN code or a (one-time) password. These serve as proof for the bank and for us that you are the legitimate holder or user of the given card. If your card uses the “Verified by Visa” or “MasterCard SecureCode” security standards, you will be asked to enter your PIN code or password. The payment will only be accepted after the correct code or password has been entered.

Real-Time Online Banking (RTOB) enables secure and easy online shopping. ABOUT PAYLANE AND ADYEN
Paylane and Adyen are organizations that process online payments and payment information on our behalf. This includes, among other things, real-time online banking, digital wallets, and bank transfers. If you make a payment via Paylane or Adyen, we will ship your package once we receive confirmation that the full payment has been made. The details of your payment will be securely transmitted to Paylane or Adyen and will be used solely to process the transaction. Under no circumstances will they be disclosed or passed on to third parties, nor will they be used for advertising purposes.
6 ORDER FULFILLMENT
The seller is obliged to deliver goods that are free from defects.
The order fulfillment time is indicated in the Store.
If the Buyer has chosen advance payment for the order, the Seller will begin processing the order after it has been paid for.
If, within a single order, the Buyer has purchased goods with different delivery times, the order will be fulfilled according to the delivery time applicable to the goods with the longest lead time.
Goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:

§7 RIGHT OF WITHDRAWAL FROM THE CONTRACT
The consumer has the right to withdraw from a contract concluded with the Seller via the Store, subject to § 8 of the Terms and Conditions, within 30 days without giving any reason.
The period for withdrawing from the contract expires 30 days after the date:
on which the Consumer acquired possession of the goods, or on which a third party other than the carrier and indicated by the Consumer acquired possession of those goods.
on which the Consumer took possession of the last of the items, or on which a third party other than the carrier and indicated by the Consumer took possession of the last of the items, in the case of a contract obliging the transfer of ownership of multiple items that are delivered separately.
the conclusion of the contract – in the case of a contract for the supply of digital content.
In order for the Consumer to exercise the right to withdraw from the contract, they must inform the Seller, using the contact details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post or information sent by email).
The consumer may use the model withdrawal form provided at the end of the Terms and Conditions, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for the Consumer to send a statement of their intention to exercise the right to withdraw from the contract before the withdrawal period has expired.
Effects of Withdrawal from the Contract
In the event of withdrawal from the concluded contract, the Seller shall reimburse the Consumer for all payments received from them, including the costs of delivering the goods (with the exception of any additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller), without delay and in any case no later than 30 days from the day on which the Seller was informed of the Consumer’s decision to exercise the right of withdrawal from the contract.
The Seller shall refund the payment using the same means of payment as those used by the Consumer in the original transaction, unless the Consumer agrees to a different solution; in any case, the Consumer shall not incur any fees in connection with this refund.
The seller may withhold the refund until the goods have been received or until proof of their return has been provided, whichever occurs first.
The seller requests that the goods be returned to the following address: Arvato, returns department, Pitbull West Coast, ul. Kolejowa 150, 62-064 Plewiska, without delay and in any case no later than 30 days from the day on which the Consumer informed the Seller of withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the 30-day period has expired.
The consumer shall bear the direct cost of returning the goods.
The consumer is only liable for any reduction in the value of the goods resulting from using them in a way other than what was necessary to establish their nature, characteristics and functioning.
If, due to its nature, the goods cannot be returned by ordinary postal means, the Consumer will also have to bear the direct costs of returning the goods. The Consumer will be informed by the Seller of the estimated amount of these costs in the product description in the Store or when placing the order.
§8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT
The right to withdraw from a distance contract does not apply to the Consumer with regard to a contract:
where the subject of the service is a non-prefabricated item, produced according to the Consumer’s specifications or intended to meet their individual needs.
where the subject of the service is an item that is perishable or has a short shelf life.
where the subject of the service is an item supplied in sealed packaging which, once the packaging has been opened, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery.
in which the subject of the service is goods which, after delivery, by their very nature become inseparably combined with other goods.
where the subject of the service is audio or visual recordings or computer programs supplied in sealed packaging, if the packaging has been opened after delivery.
the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
in which the price or remuneration depends on fluctuations in the financial market that are beyond the trader’s control and which may occur before the withdrawal period from the contract has expired.
for the supply of digital content which is not provided on a tangible medium, if the performance has begun with the Consumer’s explicit consent before the expiry of the withdrawal period and after the trader has informed them of the loss of the right to withdraw from the contract.
§9 OUR RIGHT TO REJECT AN ORDER OR WITHDRAW FROM THE CONTRACT
The fulfillment of all orders on the Platform is subject to product availability. We expressly reserve the right to refuse any order for any reason. We also reserve the right to withdraw from the Agreement in the situations listed below, by giving written notice, without being liable for any damages or costs other than refunding the amount received from you in connection with the Agreement we have cancelled:
the product is unavailable / out of stock;
the billing information you provided is incorrect or cannot be verified;
Your order has been flagged by our security system as unusual or potentially fraudulent.
you are acting in the capacity of a reseller;
there was an error in the price displayed on the Platform; or
we were unable to deliver the order to the address you provided;
§10 COMPLAINTS
If a product is found to be defective, the Buyer may file a complaint about the defective product on the basis of statutory warranty under the Civil Code or under a guarantee, if such a guarantee has been provided.
By exercising the statutory warranty for defects, the Buyer may, under the terms and within the time limits set out in the Civil Code:
submit a statement on a price reduction
in the event of a material defect – submit a notice of withdrawal from the contract
demand that the item be replaced with one free from defects
demand that the defect be removed
The Seller requests that complaints under statutory warranty be submitted to the postal or email address indicated in § 2 of the Terms and Conditions.
If it turns out that, in order to consider the complaint, it is necessary to deliver the advertised goods to the Seller, the Buyer is obliged to deliver these goods, and in the case of a Consumer, at the Seller’s expense, to the following address: Arvato, returns department, Pitbull West Coast, ul. Kolejowa 150, 62-064 Plewiska.
If an additional warranty has been granted for the goods, information about it, as well as its terms and conditions, is available in the product description in the Store.
Complaints regarding the operation of the Store should be sent to the email address indicated in § 2 of the Terms and Conditions.
The Seller will review the complaint within 14 days.
Out-of-court methods of handling complaints and pursuing claims
If the complaint procedure does not bring the result expected by the Consumer, the Consumer may make use, among others, of:

§11 PERSONAL DATA
The Seller is the controller of the personal data provided by the Buyer while using the Store.
The Buyer’s personal data are processed primarily on the basis of the contract and for the purpose of its performance, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and of the Council (EU). Detailed information regarding the processing of data by the Seller is provided in the privacy policy published in the Store.
§12 RESERVATIONS
The Buyer is prohibited from providing content of an unlawful nature.
Each order placed in the Store constitutes a separate sales agreement and requires separate acceptance of the Terms and Conditions. The agreement is concluded for the duration and purpose of fulfilling the order.
Contracts concluded on the basis of these terms and conditions are made in the Polish language.
None of the provisions of these terms and conditions exclude or in any way limit the Consumer’s rights arising from applicable law.
The provisions concerning goods and the sales contract apply accordingly to digital content and the contract for the supply of digital content, unless these matters are regulated separately in the Terms and Conditions.
§13 PROVISIONS CONCERNING BUYERS WHO ARE NOT CONSUMERS
The right to withdraw from a distance contract does not apply to any entity other than the Consumer.
Any liability of the Seller towards the Buyer who is not a Consumer is limited to the amount of the order placed by the Buyer.
The Seller’s liability under warranty towards a Buyer who is not a Consumer is limited to one year from the date the goods are delivered to the Buyer.
In the event of any dispute with a Buyer who is not a Consumer, the court having jurisdiction shall be the court with jurisdiction over the Seller’s registered office.

§4 ACCOUNT
Creating an Account is entirely voluntary and depends on the Buyer’s decision.
The account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of an order, or independently editing the Buyer’s data.
To create an Account, you must complete the appropriate form in the Store.
When the Account is created, an agreement for an indefinite period is concluded between the Buyer and the Seller for maintaining the Account under the terms set out in these Terms and Conditions.
The Buyer may cancel the Account at any time without incurring any costs.
To cancel your Account, you must send your resignation to the Seller at the e-mail address: info@medicspot.eu, which will result in the immediate deletion of the Account and termination of the agreement with respect to maintaining the Account.
§5 COMPLAINTS
Complaints regarding the functioning of the Account should be sent to the email address info@medicspot.eu.
The Seller will review the complaint within 14 days.

§7 DISCLAIMERS
The Buyer is prohibited from providing content of an unlawful nature.
The agreement for maintaining the Account is concluded in Polish.
If important reasons referred to in paragraph 4 arise, the Seller has the right to amend these Account Terms and Conditions.
The important reasons referred to in paragraph 3 are:
the need to adapt the Store to legal regulations applicable to the Store’s operations
improving the safety of the service provided
a change to the Account’s functionality that requires an amendment to the Account Terms and Conditions.
The Buyer will be informed about the planned amendment to the Account Terms and Conditions at least 7 days before the change comes into effect, via an email sent to the address assigned to the Account.
If the Buyer does not accept the planned change, they should inform the Seller by sending an appropriate message to the Seller’s e-mail address info@medicspot.eu, which will result in termination of the agreement regarding the maintenance of the Account at the moment the planned change comes into effect, or earlier if the Buyer requests this.
If the Buyer does not object to the planned change before it takes effect, it is assumed that they accept it, which does not in any way prevent the contract from being terminated in the future.
In the event of any dispute with a Buyer who is not a Consumer, the court having jurisdiction shall be the court with jurisdiction over the Seller’s registered office.
None of the provisions of these terms and conditions exclude or in any way limit the Consumer’s rights arising from applicable law.
Newsletter Terms and Conditions
§1 DEFINITIONS
Newsletter – a free-of-charge service provided electronically, through which the Service Recipient can receive, by electronic means, previously requested messages from the Service Provider concerning the Store, including information about offers, promotions, and new products in the Store.
Store – the online store medicspot.eu operated by the Service Provider at www.medicspot.eu
Service provider – The online store operating at www.medicspot.eu is run by P.B.W.C. Service Recipient – any entity using the Newsletter service.
§2 Newsletter
The Service Recipient may voluntarily use the Newsletter service.
To use the Newsletter service, you need a device with an up-to-date web browser that supports JavaScript and cookies, has Internet access, and an active email account.
Emails sent as part of this service will be sent to the email address provided by the User when subscribing to the Newsletter.
In order to conclude the contract and subscribe to the Newsletter service, the Client shall first enter, in the designated place in the Store, their e‑mail address to which they wish to receive messages sent as part of the Newsletter. Then, to the e‑mail address provided in the first step, the Service Provider will send the Client a message verifying the e‑mail address, which will contain a link for the Client to confirm their intention to subscribe to the Newsletter. Once the Client has confirmed their intention to subscribe to the Newsletter, the service agreement is concluded and the Service Provider will begin providing the service to the Client.
Messages sent as part of the Newsletter will include information on how to unsubscribe, as well as a link for unsubscribing.
The Service Recipient may unsubscribe from the Newsletter at any time, without giving a reason and without incurring any costs, by using the option referred to in section 5 or by sending a message to the Service Provider’s email address: info@medicspot.eu.
If the Service Recipient uses the link to unsubscribe from the Newsletter or sends a message requesting to unsubscribe from the Newsletter, this will result in the immediate termination of the agreement with respect to the provision of this service.
§3 Complaints
Complaints regarding the Newsletter should be submitted to the Service Provider at the following e-mail address: info@medicspot.eu.
The Service Provider will respond to the complaint within 14 days of receiving the complaint submission.
§4 Personal data
The Service Provider is the controller of the personal data provided by the Service User when using the Newsletter.
The Service Recipient’s personal data are processed primarily on the basis of the contract and for the purpose of its performance, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and of the Council (EU). Detailed information on data processing by the Service Provider is contained in the privacy policy published in the Store.
§5 Final provisions
The Service Provider reserves the right to amend these Terms and Conditions only for important reasons. An important reason shall be understood as the necessity to amend the Terms and Conditions resulting from the modernization of the Newsletter service or from changes in legal regulations that affect the provision of the service by the Service Provider.
Information about the planned amendment to the terms and conditions will be sent to the Service Recipient’s email address provided when subscribing to the Newsletter, at least 7 days before the changes come into effect.
If the Service Recipient does not object to the planned changes before they take effect, it is assumed that they accept them.
If the Service Recipient does not accept the planned changes, they should send a notice to the Service Provider’s email address info@medicspot.eu, which will result in termination of the service agreement at the moment the planned changes come into effect.
